Terms of Service

1. Agreement to Terms

By accessing our website at endurance-digital.co.uk or engaging Endurance Digital for web design, hosting setup, or website management services, you agree to be bound by these Terms of Service and our project proposal agreements.

2. Services & Project Scope

Endurance Digital provides bespoke web development, managed hosting setup, domain configuration, and continuous website care. Specific project deliverables, monthly edit allocations, build timelines, and fees are defined in individual project proposals and client service contracts prior to project kick-off.

3. Monthly Subscriptions & Billing

For clients enrolled in our Managed Website Service:

• Recurring Payments: Subscription fees are billed automatically via Stripe on a monthly basis.
• Edit Allowance: Monthly content update allocations (e.g., 30 mins or 1 hour) apply to text, photo, or minor section updates and do not roll over month-to-month. Major structural overhauls will be quoted separately.
• Cancellation: Monthly plans operate on a rolling month-to-month basis (following any agreed initial term) and may be canceled with 30 days' written notice sent to hello@endurance-digital.co.uk.

4. Client Content & Intellectual Property

Clients are solely responsible for providing necessary brand copy, logos, graphics, and images required for their project. Clients warrant that all provided materials do not infringe upon any third-party copyrights or trademarks. Upon full payment of all fees, clients retain ownership of their unique text and image assets.

5. Service Availability & Uptime

While we deploy sites across high-performance global cloud networks with continuous uptime monitoring, Endurance Digital does not guarantee 100% uninterrupted service against third-party network outages, registrar downtime, or external infrastructure disruptions.

6. Limitation of Liability

To the maximum extent permitted by UK law, Endurance Digital shall not be liable for any indirect, incidental, consequential, or economic loss, including loss of profits, data, or business opportunity, arising out of website usage or service interruptions.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Scotland and the United Kingdom, and any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
